Introduction

Welcome to Morbhagwan.in! These Terms and Conditions ("Terms") govern your access to and use of the Morbhagwan.in mobile application ("App," "Service," "we," "us," or "our").

1. ACCEPTANCE OF TERMS

1.1 Agreement to Terms

By creating an account, accessing, or using the Morbhagwan.in App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy.

1.2 Legal Capacity

You represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into binding contracts
• You are not prohibited from using the App under applicable laws
• All information you provide is accurate and truthful

1.3 Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App or on our website. Your continued use of the App after changes constitutes acceptance of the modified Terms.

2. USER ACCOUNTS

2.1 Account Creation

To access certain features of the App, you must create an account by providing:

• Valid email address or phone number
• Secure password
• Basic profile information

2.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date
• Not sharing your account with others

2.3 One Account Per User

Each user is permitted only one account. Creating multiple accounts may result in account suspension or termination.

2.4 Account Security

• Choose a strong, unique password
• Do not share your password with anyone
• Log out from shared devices
• Report suspicious activity immediately to support@morbhagwan.in

2.5 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms and Conditions
• Engage in fraudulent or illegal activities
• Abuse or harass other users
• Attempt to hack or compromise the App
• Provide false or misleading information

3. ACCEPTABLE USE POLICY

3.1 Permitted Use

You may use the Morbhagwan.in App for:

• Personal spiritual and devotional purposes
• Accessing religious content and resources
• Accessing e-commerce products
• Sharing content through provided sharing features

3.2 Prohibited Activities

You agree NOT to:

Illegal Activities:

• Violate any local, state, national, or international laws
• Engage in any unlawful or fraudulent activities
• Use the App for money laundering or terrorist financing

Content Violations:

• Upload, post, or share offensive, abusive, or hateful content
• Share content that promotes violence, discrimination, or harassment
• Post sexually explicit or pornographic material
• Share false, misleading, or defamatory information
• Infringe on intellectual property rights of others

Technical Violations:

• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems
• Upload viruses, malware, or malicious code
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the App's functionality
• Bypass security measures or authentication systems

Misuse:

• Impersonate other users or entities
• Create fake accounts or profiles
• Spam or send unsolicited commercial messages
• Harvest user data without permission
• Use the App for commercial purposes without authorization
• Resell, redistribute, or sublicense App content

4. INTELLECTUAL PROPERTY RIGHTS

4.1 Our Content and Ownership

All content, features, and functionality of the Morbhagwan.in App, including but not limited to:

• Text, graphics, logos, icons, images
• Audio clips, videos, music, mantras, bhajans
• Software, code, and algorithms
• Design, layout, and user interface
• Trademarks, service marks, and trade names

are the exclusive property of Morbhagwan.in or its licensors and are protected by:

• Indian Copyright Act, 1957
• Trademark laws
• International intellectual property treaties
• Other applicable laws

4.2 Limited License to Users

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the App for personal, non-commercial purposes
• Download content for offline personal use only
• Share content using provided sharing features

You may NOT:

• Copy, modify, distribute, or reproduce App content commercially
• Remove copyright or proprietary notices
• Create derivative works without permission
• Use our trademarks without written consent

4.3 User-Generated Content

When you submit, post, or upload content to the App ("User Content"), you:

• Retain ownership of your User Content
• Grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and promoting the App
• Warrant that you own or have necessary rights to your User Content
• Agree that your User Content does not violate any third-party rights

4.4 Content Removal

We reserve the right to remove any User Content that:

• Violates these Terms
• Infringes on intellectual property rights
• Is reported by users as inappropriate
• We determine, in our sole discretion, to be objectionable

4.5 Copyright Infringement Claims

Please include:

• Description of copyrighted work
• Location of infringing content in the App
• Your contact information
• Statement of good faith belief
• Statement under penalty of perjury
• Your physical or electronic signature

5. SERVICES AND FEATURES

5.1 App Features

Morbhagwan.in provides various features including:

• Selling of devotional products
• Pandit Booking: Connecting users with independent Pandits (priests)
• Watching free devotional content
• Redirecting users for paid OTT content
• Providing Pooja Vidhi and devotional information

5.2 Service Availability

We strive to provide uninterrupted service, but we do NOT guarantee that:

• The App will be available at all times without interruption
• The App will be error-free or free from bugs
• Defects will be corrected immediately
• The App is free from viruses or harmful components
• Results obtained from the App will be accurate or reliable
• The quality of any services, information, or content will meet your expectations

5.3 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature or service
• Update App functionality and content
• Change system requirements
• Introduce new features or remove existing ones

We will provide reasonable notice for significant changes that affect your use of the App.

5.4 Third-Party Services

The App may integrate with third-party services (payment gateways, social media, analytics etc). We are not responsible for the functionality, privacy practices, or content of these third-party services.

6. PAYMENTS AND REFUNDS

6.1 Product Payments (E-commerce)

• Payments for physical devotional products are processed securely through authorized payment gateways.
• We accept credit cards, debit cards, UPI, and digital wallets for product purchases.
• You authorize us to charge your selected payment method for products ordered through the App.

6.2 Offline Payments (Services)

As stated in Section 5.1, Morbhagwan does not handle payments for Pandit services. The Company shall not be liable for any financial disputes, overcharging, or failure of payment between the User and the Pandit.

6.3 Refund & Cancellation Policy

• For Products: 7-Day Money-Back Guarantee for physical products if requested within 7 days.
• For Pandit Services: Since payments are made directly to the Pandit, Morbhagwan **does not provide refunds** for ritual services. Any disputes regarding the quality or cost of the ritual must be resolved directly with the Pandit.
• No-Show Policy: Users who book a Pandit and fail to be present (No-Show) without 24-hour notice may have their accounts suspended.

7. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Merchantability: Fitness for a particular purpose
• Non-Infringement: Of third-party rights
• Accuracy: Of content or information provided
• Completeness: Of services or features
• Reliability: Of App performance
• Security: Absolute protection against security breaches

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected
• The App is free from viruses or harmful components

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

8.1 No Liability for Damages

MORBHAGWAN.IN, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS SHALL NOT BE LIABLE FOR ANY:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of or damage to property
• Personal injury or emotional distress
• Business interruption
• Loss of business opportunity

ARISING FROM:

• Your use or inability to use the App
• Any unauthorized access to your data
• Errors, mistakes, or inaccuracies in content
• Any interruption or cessation of services
• Any bugs, viruses, or malicious code
• Any third-party content or conduct

8.2 Maximum Liability

In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim, or INR 1,000 (whichever is less).

8.3 Jurisdictional Limitations

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the fullest extent permitted by law.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Morbhagwan.in, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your violation of these Terms and Conditions
• Your violation of any rights of third parties
• Your violation of applicable laws or regulations
• Your User Content or any content you submit
• Your use or misuse of the App
• Your breach of any representations or warranties

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

10. DISPUTE RESOLUTION

10.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@morbhagwan.in to attempt to resolve the dispute informally for at least 30 days.

10.2 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996.

10.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.

Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.

11. GOVERNING LAW AND JURISDICTION

11.1 Applicable Law

These Terms and Conditions are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

11.2 Jurisdiction

Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Raipur, Chhattisgarh, India. You consent to the personal jurisdiction of these courts.

11.3 Compliance with Laws

You agree to comply with all applicable local, state, national, and international laws and regulations in your use of the App.

12. TERMINATION

12.1 Termination by You

You may terminate your account at any time by:

• Using the in-app account deletion feature
• Contacting support@morbhagwan.in
• Following our Data Deletion Policy

12.2 Termination by Us

We may suspend or terminate your access immediately, without notice, if you:

• Violate these Terms and Conditions
• Engage in fraudulent or illegal activities
• Abuse, harass, or threaten other users
• Attempt to compromise App security
• Fail to pay subscription fees

12.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Your account data may be deleted (as per our Data Retention Policy)
• You remain liable for any obligations incurred before termination
• Provisions that should survive (indemnification, limitation of liability, dispute resolution) remain in effect
• No refund of unused subscription fees unless otherwise stated

13. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Our collection, use, and protection of your personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you consent to:

• Collection and use of your information as described in our Privacy Policy
• Transfer of data to third-party service providers
• Use of cookies and tracking technologies
• Receiving communications from us

14. COMMUNICATIONS

14.1 Electronic Communications

By using the App, you consent to receive electronic communications from us, including:

• Emails to your registered email address
• Push notifications through the App
• In-app messages and announcements
• SMS messages (if you opt-in)

14.2 Opting Out

You can opt-out of promotional communications by:

• Clicking "unsubscribe" in emails
• Adjusting notification settings in the App

You cannot opt-out of essential service-related communications.

15. FORCE MAJEURE

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

• Natural disasters (earthquakes, floods, fires)
• Acts of war, terrorism, or civil unrest
• Government actions or regulations
• Pandemics or health emergencies
• Internet service provider failures
• Power outages or telecommunications failures
• Strikes or labor disputes

16. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms and Conditions, together with our Privacy Policy and any other legal notices or policies published in the App, constitute the entire agreement between you and Morbhagwan.in concerning your use of the App and supersede all prior agreements, understandings, or communications.

18. NO WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Morbhagwan.in.

19. ASSIGNMENT

You may not assign, transfer, or delegate these Terms or your rights and obligations without our prior written consent. We may assign these Terms to any affiliate or successor entity without restriction.

20. FEEDBACK AND SUGGESTIONS

We welcome your feedback, comments, and suggestions for improving the App. You may submit feedback to feedback@morbhagwan.in.

By submitting feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate your feedback into our products and services without any obligation to compensate you.

21. THIRD-PARTY RIGHTS

These Terms do not confer any rights or remedies upon any person other than you and Morbhagwan.in.

22. LANGUAGE

These Terms are prepared in English. In case of any translation, the English version shall prevail in case of discrepancies.

BY CLICKING "I AGREE," CREATING AN ACCOUNT, OR USING THE MORBHAGWAN.IN APP, YOU ACKNOWLEDGE THAT:

• ✓ You agree to be bound by these Terms
• ✓ You meet the eligibility requirements
• ✓ You have the authority to enter into this agreement
• ✓ You will comply with all applicable laws

If you do not agree with these Terms, you must immediately stop using the App and delete it from your device.
